Terms and Conditions of Use of the SKY24.EE Website
1. General Provisions
1.1. The www.sky24.ee website is made available by Estravel Group AS (registry code 10325720, VAT EE100141652, address Suur-Karja 15, Tallinn, Estonia, e-mail info@sky24.ee, telephone (special tariff €0.49/min, calls outside Estonia +372 646 1461, for changes to the reservation +372 646 1464)) (hereinafter referred to as SKY24.EE).
1.2. The Website SKY24.EE has made available the single travel services of the Service Providers such as passenger transport service, accommodation service or travel insurance. SKY24.EE makes these services available as individual travel services, which means that only one type of travel services can be purchased during the Website’s one-time visit, such as a purchase of an airline ticket or a hotel accommodation. The travel services made available through the Website are not part of the package and are not related to travel arrangements within the meaning of the Tourism Act and therefore are not subject to the obligation of the travel agent’s guarantee.
1.3. By using this website, you confirm that you have read the terms and conditions of use of this website, incl. the Service Provider’s Terms and Conditions of Sale set out in article 6, and our valid Privacy Policy, accept them in full and undertake to adhere to them. Here by you also confirm to have read and accepted the campaign terms for any ongoing campaign in SKY24.EE.
1.4. If any of the provisions of the Terms and Conditions of Use proves to be invalid due to being in contravention to law, it will not lead to the invalidity of the other provisions.
1.5. In the event of a contradiction between the Terms and Conditions of Use and the Service Provider’s Terms and Conditions of Sale established by the third parties who provide their services via the Website, the latter shall apply.
2. Definitions
The terms and abbreviations used in the Terms and Conditions of Use of the Website have the following meaning:
Terms and Conditions of Use – these Terms and Conditions of Use of the Website with the Service Provider’s Terms and Conditions of Sale
Website – the website at https://www.sky24.ee
Client – the user of the Website and/or travel service
Activities – use of the Website by the Client
Service Provider – the third party whose single travel service provided can be viewed and/or purchased on the Website or via the Website
Order Confirmation – the document issued by the Service Provider or SKY24.EE which confirms that a single travel service contract has been entered into between the Client and the Service Provider and which grants the right to use the travel service (airline ticket, travel insurance policy etc.). Confirmation of the booking of travel service, information or any other overview of the content of the booking does not constitute an Order Confirmation.
3. SKY24.EE Service
3.1. The service provided by SKY24.EE gives Clients access to a portal on the Website which allows the Clients to make queries about the single travel services of the Service Providers (airline tickets or accommodation or travel insurance) as well as other services, to check their availability and to book travel services, pay for travel services and receive Order Confirmations in return. General information concerning travel is also made available on the Website.
3.2. Providing Clients with access to the travel services of the Service Providers via the Website does not make SKY24.EE liable for the provision of the travel services of the Service Providers or the quality of the travel services and their correspondence to the pre-contractual information and sales promises given by the Service Provider, but the Client does have the right to file complaints against the Service Providers via SKY24.EE, who will forward the complaints to the Service Providers and make every effort to resolve the complaints.
3.3. The opportunities to buy travel services, including their terms and conditions, prices and availability are constantly changing, because they depend on demand and supply for travel services.
3.4. Any bookings of the travel services of any Service Providers made by the Client during the Website’s single visit with a payment made for the booked services constitute the Client’s proposal to buy the selected travel service from the Service Provider. The Client’s proposal is preserved by SKY24.EE electronically for fourteen (14) days and e-mailed to the Client by SKY24.EE at the Client’s request. If the Service Provider agrees with the Client’s proposal, the Service Provider or SKY24.EE e-mails the relevant confirmation to the Client. The contract between the Client and the Service Provider in respect of the relevant travel services is deemed to have been entered into from the moment the agreement of the Service Provider with the Client’s proposal is received.
3.5. The contract is not entered into if the Service Provider does not agree with the Client’s proposal and SKY24.EE refunds the payment made by the Client.
4. Use of the Website
4.1. Travel services may only be booked and orders for travel services may only be placed via the Website by adults with full active legal capacity i.e. persons who are at least 18 years old and representatives of Clients who are legal entities. The person responsible for the consequences if a person who does not comply with said requirements books a travel service or places an order for a travel service is the person whose bank account or credit card was used to pay for said Activity.
4.2. The Client performs the Activities pursuant to the provisions of the Terms and Conditions of Use and the user instructions displayed on the Website. When performing the Activities, the Client carefully checks the details of the order given during the performance of the Activities and bears responsibility for the data presented in the orders they give being correct as well as the risk for the potential damage caused by any errors made by them. All of the details entered by the Client are displayed on the Website for the purpose of identifying and correcting any errors before a travel service is booked or an order for a travel service is placed via the Website.
4.3. SKY24.EE has the right to not perform an order placed by the Client if the Client has not adhered to the Terms and Conditions of Use or the user instructions displayed on the Website, not paid for the booking or if the funds on the Client’s credit card are insufficient to pay for the order given in relation to an Activity and the service charge of SKY24.EE which is also subject to payment.
4.4. SKY24.EE sends the Order Confirmation to the e-mail address given by the Client. The Client must immediately inform SKY24.EE if the Order Confirmation is not received at their e-mail address within a reasonable time after paying for the travel services.
4.5. The Client must immediately inform SKY24.EE of any errors, contradictions or faults that obstruct the use of the Website.
4.6. The Client immediately checks their first name and surname, itinerary, dates and other important data immediately after receipt of the Order Confirmation and makes sure that they are correct and correspond to the booking and the details entered. It is important to check that the Client’s name given in the booking and the Order Confirmation matches the name given in the Client’s travel document. SKY24.EE eliminates technical errors caused by SKY24.EE or a Service Provider when documents are issued. Elimination of errors, amendment or annulment at a later time is impossible or only permitted for an extra charge.
4.7. When using the Website, the Client must:
4.7.1. guarantee that all of the information submitted by them when using the Website is correct;
4.7.2. not forward any illegal or otherwise prohibited information via the Website;
4.7.3. not use the Website for speculative or incorrect Activities or fraud;
4.7.4. not send files via the Website which contain viruses and other computer programmes or files which disturb, damage or otherwise obstruct the normal use of the Website and which may be saved in the computers of other Clients as a result of use of the Website and/or disturb, damage or otherwise obstruct the normal functioning of computers;
4.7.5. not change, copy, forward, sell or reproduce the Website or its content or use it in any other prohibited manner.
4.8. The Client who purchases the travel service (e.g. a flight ticket or accommodation service or travel insurance) to another person (Representative) must, after receiving the confirmation, immediately verify the accuracy of name(s), itinerary, the dates of the travel services and any other relevant data. The names must be written as in the passport or ID card. In case of any mistakes on the confirmation, SKY24.EE has to be informed immediately by the representative.
4.9. The representative is obliged to forward all data and documents related to the travel service to the persons to whom he/she has purchased the travel service and the relevant data and documents concerning the persons concerned to SKY24.EE, respectively. The notification obligation is considered fulfilled by SKY24.EE if it has forwarded the information concerning travel services to the Representative and does not have to be delivered to each passenger/customer separately.
4.10. The Client and/or the Representative shall be responsible to SKY24.EE for the correctness of the data provided by him, such as travelling time, passenger names, date of birth, other personal data and special needs of passengers. The representative is obliged to verify that SKY24.EE has all the passenger contact information (mobile phone number and e-mail address).
5. Information Displayed on Website
5.1. The general travel information about passports, visas, vaccination requirements etc. displayed on the Website is there to meet the need for general information and may change at any time independently of SKY24.EE. The Client shall personally check that this information is up to date by contacting the Service Provider, the Ministry of Foreign Affairs, the Tourist Information Office or other agencies and bear responsibility for understanding and observing the established requirements. Citizens of the Republic of Estonia can obtain further information from the website of the Ministry of Foreign Affairs at http://www.vm.ee. Information about vaccination and health requirements as well as the regions where the risk of contracting an infectious disease is high can be viewed on the website https://ta.vaktsineeri.ee/en/. Different requirements may apply to citizens of other countries.
5.2. The Service Providers presume that the Client or the person who uses the travel service, incl. children, have the required travel documents (passport/ID card, visa and vaccination certificate) allowing them to enter the country of destination as well as all transit countries. Clients must bear in mind that every country can decide at its own discretion whether or not they allow a person to enter the country, even if the person has all of the required travel documents.
5.3. SKY24.EE makes every effort to guarantee that the information about the terms and conditions of sale of the Service Providers (including but not limited to the prices of travel services and the descriptions of travel services or dates) displayed on the Website is free or errors and omissions. SKY24.EE guarantees that information is displayed on the Website in the manner given by the Service Provider to SKY24.EE, but does not guarantee that the information is correct. SKY24.EE makes every effort to eliminate any errors or omissions as soon as they are detected.
6. Terms and Conditions of Sale of Service Provider
6.1. The Terms and Conditions of Sale of the Service Provider, such as the terms and conditions of sale of airline tickets, the terms and conditions of accommodation services, the Privacy Policy etc also apply in addition to the Terms and Conditions of Use when a travel service of the Service Provider is bought. The Terms and Conditions of Sale of the Service Provider may contain provisions that concern payment terms, liability, cancellation and amendment of bookings/contracts, payment of compensation and restrictions.

6.3. The Client must check and observe the terms and conditions established by the Service Provider independently. Failure to observe the terms and conditions of the Service Provider may result in, for example, cancellation of the order or the incurring of unexpected additional costs by the Client to continue their travels.
6.4. If the Terms and Conditions of Sale of the Service Provider allow the client to cancel or change the booked or bought travel service, the Client must inform the Service Provider thereof according to the requirements established by the latter in the event that the Client exercises this right. The Service Provider may be informed via SKY24.EE, unless this is in contravention of the requirements established by the relevant Service Provider.
7. Travel Insurance
7.1. We ask the Client to enter into a travel insurance contract when the Client buys a travel service. Travel insurance guarantees assistance and indemnity in the event of unexpected interruption or cancellation of travel, loss of baggage, the Client’s health problems and/or accidents etc. under the terms and conditions established by the insurer.
7.2. We recommend purchasing additional travel interruption insurance in order to alleviate risks that are beyond the control of the passenger, such as strikes, bankruptcy, accidents, illness, cancellation of the public event serving as the purpose of the trip, technical failures, complicated meteorological conditions and natural disasters. If required, such insurance should be purchased with additional cover that is also charged separately. The insurance should be purchased immediately after purchasing the flight ticket (generally within 48 hours).
8. Payment Terms and Service Charges of SKY24.EE
8.1. The Client must pay the full price of the travel service when booking a travel service via the Website. The Client pays the price of the travel service via an internet bank or by credit card to SKY24.EE, who forwards the fee paid by the Client to the Service Provider.
8.2. The Client must follow the instructions displayed on the Website when paying for the travel service booked by the Client. By paying for the travel service, the Client and/or the Representative shall confirm the correctness of the information provided to or submitted by SKY24.EE.
8.3. SKY24.EE and the Service Providers are not obliged to issue Order Confirmations, vouchers or other documents to the Client before the price of the booked travel service is paid in full. At the same time, the Client also remains responsible for payment of the agreed price for the travel service in the event that an Order Confirmation is issued to them before the price of the travel service is paid in full.
8.4. The Activities that are subject to a service charge and the amount of the service charge is indicated on the SKY24.EE price list. The amount of the service charge payable for an Activity and the payment method are also displayed on the Website in a separate row before the relevant Activity (e.g. the travel service of the Service Provider) is performed. Cancellation of a booking, not buying a travel service of the Service Provider or leaving the travel service of the Service Provider partially or fully unused does not constitute a basis for receiving a refund for the service charge. The service charge is also applied if the travel service of the Service Provider is cancelled due to the circumstances beyond SKY24.EE control.
9. Filing claims and client’s right of withdrawal
9.1. The Service Provider must be immediately informed if the Client feels that the travel service does not meet the terms and conditions established by the Service Provider. If no solution is found, a written complaint must be filed about the case within seven (7) days of the end of the provision of the travel service and no later than within fourteen (14) days of becoming aware of the case. The written complaint must be filed against the Service Provider and sent either directly to the Service Provider’s postal or e-mail address or to the postal or e-mail address of SKY24.EE. Proof of the travel service’s non-compliance and documents evidencing additional costs and damages incurred must be enclosed with the complaint. Complaints not submitted by the established deadline are deemed to have expired.
9.2. In accordance with the Law of Obligations Act, it is not permitted for clients and consumers to withdraw from contracts entered into for the provision of transport services for passengers since the provision of the service by a certain date or within a certain term has been determined in the contract or the entry into a contract means the reservation of certain resources for which it is difficult to find a new user upon withdrawal. Clients and consumers must take into account the fact that, upon purchasing a plane ticket, there is no right to annul and/or return the plane ticket without charge within 14 days regardless of the reasons therefor.
10. Confidentiality
10.1. SKY24.EE will not disclose the personal data of the Customer, which have been learned by it in the course of use of the Website by the Customer, unless the disclosure takes place with the Customer’s consent or the duty or right to disclose the data arises from legislation or the Terms of Use. The processing of personal data is carried out in accordance to SKY24.EE privacy policy.
10.2. Upon booking and buying a flight ticket, the air carrier sends the Customer’s booking information, in accordance with the State Borders Act, to the Police and Border Guard Board for processing for the purpose of performance of duties aimed at processing, detecting and preventing terrorist crimes and other serious crimes. Booking information will be preserved for a period of five years, personified data will be preserved for two years as of the receipt of the data.
10.3. Booking information means information on the air passenger and travel, which the air carrier collects from the Customer to make a booking. Booking information includes, above all, information on the booking and the related steps, personal data of the passenger and persons travelling with the passenger, the overall flight data, the contact details of the passenger and data concerning payment for the booking.
10.4. Persons have all the statutory rights in connection with transfer of booking information.
11. Personal data protection strategy & protection
11.1. SKY24.EE and Estravel Group’s data protection strategy refers to the commitment of the Authorized Processor to treat the personal data of employees, customers, stakeholders and other interested parties with extreme diligence and to rely on existing data protection standards to process their data. Through this policy, we ensure that we collect, store and process data fairly, transparently and respecting the individual rights of individuals.
11.2. On a daily basis, SKY24.EE monitors that the activities are appropriate, constantly upgraded both legally, with the awareness of the workforce and technically, by monitoring the conformity of the hardware and software with technical progress.
11.3. SKY24.EE is committed to ensuring that data subjects control their data processing as much as possible and establishes a user-friendly regulation for the data subject.

12. Final Provisions
12.1. SKY24.EE has the right to amend the Terms and Conditions of Use and it’s annexes unilaterally and without notice. Any amendments to the Terms and Conditions of Use enter force on the day they are published on the Website, unless otherwise prescribed in the amendments.
12.2. The legislation of the Republic of Estonia applies to the legal relationships between the Client and SKY24.EE; litigation is subject to Harju County Court. Any disputes will be resolved by way of negotiations. Failing agreement, disputes related to Consumers will be resolved by the Consumer Complaints Committee at the address Endla 10A, 10122 Tallinn, phone (+372) 6201 707. 12.3. According to the Regulations (EU) No 524/2013 of the European Parliament and of the Council all cross-border online transaction disputes should be resolved online at http://ec.europa.eu/consumers/odr/.
12.4. The legislation of the country determined by the Service Provider applies to the legal relationships between the Client and the Service Provider, and provisions of international law are applied to transnational provision of travel services.
